Many discussions have risen within the Colombian legal theory concerning the value of the judgments of court and binding judicial activity, the interpretation and scope given to the article 231 of the Colombian constitution has been object of malleable tendencies in the early nineties, which disallowed the visualization of a new tendency to follow. However, great exponents of opposite interpretative trends have arisen among themselves about the real value of the jurisprudence in the system of sources of the Colombian law; arguments in favor of giving full linking effect to the jurisprudence, whose greatest exponent from the legal theory is the master Diego Eduardo López Medina, and as against pole of this thesis is the master Javier Tamayo Jaramillo whose ideological affinity with the ius positivism nourishes the discussion from the sphere of the risks and dangers that represents jurisprudence make a binding source in the Colombian legal system.
