Resumen
This paper addresses the ever complex problem of the legal legitimacy of the war and the regime that will govern the combatants after the end of the respective hostilities. It also deals with the international community’s awareness of the humanization of hostilities and their consequent regulation, as well as its application to domestic conflicts. In this context, new phenomena such as terrorism –especially the international one– or the immigration caused by the different conflicts around the world, propose important challenges for contemporary society and the law –fun-damentally international– designed to respond to them; several of these questions are put forward in the article, which also incorporates some response sketches.
