The Constitution’s adoption of the social market economy model has permeated all sectors in the Colombian economy, even the coal industry. The implementation of the new economic system imposed the transition in economic regulation and the application of a new set of laws to preserve competition with the purpose of safeguarding the freedoms and economic principles instituted by the constitution.The situation in the coal industry in the context adopted by the economic components of the Constitution introduces questions such as the existence of a coal market generated by the fine-tunning of the regulation; if it is regulated or not; which norms apply in this case; how to overcome legal gaps; theneed of a special set of norms on competition and the role played by different authorities.
